£13,252,33 demand from the Building Society :-(

I had a house repossessed in 1996, well actually I handed the keys into the building society and said 'write to me'  >:
So they did, 3 years later. £14,396,63 shortfall in sale price against mortgage owed.
I wrote back and explained that as it was a joint mortgage, I only owe half this amount.
An agreement was made between me and them in July 2009 that I pay £5 a month off my 50% of the debt.
So I've been happily :-( paying £5 a month for the past 13 years
If I default on payment, I may be liable for the total amount.

Yesterday I get a letter.
"It's been 3 month since we contacted you about the £13,252,33 debt you owe us.
Therefore we may take further action to recover the arrears and may apply the 8% court rate of interest on this balance."

The letter also stated that
"Your repayments have been sporadic, so your immediate correspondence is required so we can arrange for the total of this debt to be collected by ourselves."

Whoa, back off. I'm like straight on the phone to them.

Apparently, certain cases have been moved from the London office, to the Plymouth office.
Copies of agreements and such, between the society, and customers hadn't.
Hence I didn't receive there letter 3 month ago. If I had, I would have posted this 3 month ago.
£13,000 is a very large sum when you don't earn that much.
I've still got my original letters of an agreement with them from 1999
So, all I've got to do now is fill a means test form, and post it within the next 14 days.

I've also done some maths.
I've paid £780 in the last 13 years.
My Ex has paid £360
That's not a problem, an agreement is an agreement. I've stuck to mine.
And I can't see my payment increasing in the near future. I can't afford more.

Reason for this post. If you find yourself in debt, agree a payment plan, regardless of how little.
Stick to it. Keep correspondence, and don't let them grind you down.


Get a job, buy a house, see the gov rip the floor and job from under your feet, pay the repercussion.

Oddly enough Fly I had a letter from Dept for Work & Pensions about my sisters pension credit - they have just cut her benefit by 50%!!!!  :(

When I rang them to ask why, they said that she had been getting benefits she wasn't entitled to - and that any overpayment had been passed on to debt management to claim back!

1. It's their fault they've overpaid (if they have overpaid her) - when she reached 60 I simply completed the forms that they sent to me.

2. I am only the appointee - am I liable for the overpayment?

3. They didn't have her current address, nor did they have any record that she was in permanent residential care!

When I told them that I hadn't received an explanatory letter outlining the change of amount, I was told that one would be in the post. What have I received! Another pension credit form to complete and return!  >:(

Well, if that didn't spoil the start of my holiday I don't know what would!  >:(

@Cchris. I don't think you posted to wind me or Alsatian up. I appreciate what you are getting at.
I owe the Britannia money, I've never denied that or shy'ed away from it.
Just the fact they suddenly drop a letter on my door step demanding, without looking at my payments over the last x years.

As Alsatian commented. If the form's asked you this info, you'd tell then the required stuff.
If they don't, why shout you down and treat you like a thief, and this isn't a Tory bash !!

Agreed, but they always seem to send out aggressive letters first. Even when they find out it's their mistake !

I've sent the form back. Not looking forward to the result.
Apparently we spend more money on social activities etc.
There's nowt on the form about registering domains, running websites etc.
It's just aimed at the drinker/smoker.
Not spending much on fags as of late  :-X

@chesterfieldChris, IF I had filled the forms in wrongly I would have held my hands up BUT , I have filled enough of these forms in to know that I have given them 100% correct information. I am not privy to what/how much benefits make up pension credit - that's supposedly their job.
It doesn't help matters when they won't discuss with me - her appointee - what details they hold on her file.
I also agree that overpayment should be repaid BUT I also believe they should justify it.
Anyway thanks for making me feel better about it.

@ Alsatian, this is a new one on me different circumstances I know but I always thought if a person was disabled they had their pension automatically paid? Can't say I have ever been requested to fill in any forms. Does it depend on the benefits they get then once in a residential do the benefits change.
Obviously my daughter lives independant (or should - but that's another story/ cock up)
Still brings added pressure which we could all do without.
@Fly, you are quite right about the letters that can be sent out, raises the hair on the back of my neck - I just go for the jugular  >:
